General Terms and Conditions

Last updated: October 2026

These general terms and conditions apply to all trips, treks, day tours and additional services booked directly with Incatrekkers. If you book a complete package (for example including flights) through our partner Silvertip Tours, the terms and conditions of Silvertip Tours apply.

1. Company

The tour operator is Incatrekkers Peru Travel E.I.R.L., RUC 20608131702, Apv. Virgen Concepción W2-B, Cusco, Peru, trading as "Incatrekkers". Incatrekkers is a licensed travel agency and tour operator in Peru and an official Inca Trail operator (No. 243-2021-GR/GERCETUR-SGFC).

These terms are based on Peruvian law, in particular the Consumer Protection Code (Ley N.º 29571), the Regulation on Travel and Tourism Agencies (D.S. N.º 005-2020-MINCETUR), the Complaints Book Regulation (D.S. N.º 011-2011-PCM), the Personal Data Protection Law (Ley N.º 29733) and the rules of the Ministry of Culture and SERNANP on the Inca road network and access to Machu Picchu.

2. Booking, contract and payment

  • Enquiry: The traveller enquires via the website, by e-mail or WhatsApp. Incatrekkers checks the availability of permits for the Inca Trail and Machu Picchu.
  • Confirmation: Incatrekkers sends an offer with price, services and these terms.
  • Deposit: The contract is concluded on receipt of a 30% deposit. Only then does Incatrekkers buy permits, Machu Picchu tickets and train tickets. By paying the deposit, the traveller accepts these terms.
  • Balance: The balance is paid by payment link no later than 30 days before the start of the trip. For bookings made less than 30 days before departure, the full price is due immediately.
  • Details for permits: The traveller provides name, passport number, nationality and date of birth exactly as shown in the passport and sends a copy of the passport when booking. Inca Trail permits and Machu Picchu tickets cannot be corrected after purchase.
  • Payment fees: Fees for credit card or payment link payments (4%) are paid by the traveller.

3. Prices and services

Prices are in US dollars per person. They depend on the group size: shared group (4 to 12 people) or private trip from 1 person. The services included are listed in the trip description and in the offer.

  • Not included, unless stated otherwise: international and domestic flights, travel insurance, tips, personal expenses, meals and entrance fees not mentioned.
  • Taxes: Prices include Peruvian VAT (IGV) and all taxes. No additional taxes are charged.
  • Price changes: If the government raises fees for permits, entrance or trains after booking, Incatrekkers may charge the difference. The traveller will be informed immediately.

4. Cancellation by the traveller

If the traveller cancels, Incatrekkers charges a percentage of the trip price depending on the type of trip and the date. Cancellations must be made in writing (e-mail or WhatsApp); the date of receipt by Incatrekkers applies.

Inca Trail and trips with a permit or Machu Picchu ticket:

  • 60 days or more before departure: 30% (the deposit)
  • 59 to 30 days before: 50%
  • 29 to 15 days before: 75%
  • less than 15 days before or no-show: 100%

Other treks and multi-day trips:

  • 60 days or more before departure: 10%, minimum USD 50
  • 59 to 30 days before: 30%
  • 29 to 15 days before: 50%
  • 14 to 3 days before: 75%
  • less than 3 days before or no-show: 100%

Day tours:

  • up to 7 days before: free of charge
  • 6 to 2 days before: 50%
  • less than 48 hours before or no-show: 100%

Tickets already purchased (for example train and entrance to Machu Picchu) are always charged.

  • Why the Inca Trail deposit is not refunded: Permits and Machu Picchu tickets are personal. The authorities do not refund them and do not allow them to be transferred to another person.
  • Third-party costs: Non-refundable costs for flights, hotels, trains and entrance fees that Incatrekkers has purchased for the traveller are always charged, even if they exceed the percentage stated.
  • Substitute traveller: For trips without a permit, the traveller may name a substitute up to 7 days before departure. Only the actual additional costs are charged.
  • Credit instead of cancellation fees: If the traveller cancels 30 days or more before departure, Incatrekkers may offer a credit for another trip within 12 months instead of the cancellation fees (not valid for permits or tickets).
  • Cancellation insurance: We strongly recommend insurance that covers cancellation costs.

5. Changes by the traveller

  • Inca Trail: Once the permit has been purchased, the date and names cannot be changed and the passport details cannot be corrected. A change of date counts as a cancellation and a new booking, subject to permit availability.
  • New passport: If the traveller receives a new passport after booking, they must provide the old and the new number and bring both passports.
  • Other trips: Date changes are possible once free of charge up to 30 days before departure, subject to availability. After that, the cancellation fees apply. Additional costs for trains, tickets or hotels are paid by the traveller.
  • During the trip: Unused services, for example if the traveller leaves the trip early, are not refunded.

6. Changes and cancellation by Incatrekkers, force majeure

  • Minimum number of participants: If a shared group does not reach the minimum, Incatrekkers offers the trip as a private trip at the group price, another date or a full refund. Cancellation is communicated no later than 14 days before departure.
  • Last-minute changes: Weather, landslides, trail closures, strikes or official orders may require changes to the route or itinerary. The guide decides on site with safety in mind and offers an equivalent alternative where possible.
  • Force majeure: If a trip cannot take place for reasons beyond Incatrekkers' control, Incatrekkers refunds the price minus costs that cannot be recovered (for example permits and tickets). A change of date is also possible.
  • Inca Trail in February: The Inca Trail closes every February for maintenance. There are no Inca Trail treks in that month.

7. Health, altitude, safety and insurance

  • Health and fitness: The traveller is responsible for being in suitable health and physical condition for the chosen trip and informs Incatrekkers when booking about pre-existing conditions, allergies or pregnancy.
  • Altitude: Many trips go above 4,000 m. We recommend at least two days in Cusco to acclimatise before any trek.
  • Guide's decision: For safety reasons, the guide may stop a traveller from continuing, for example in the case of severe altitude sickness. This does not give rise to a refund.
  • Insurance: Travel insurance with medical, accident and rescue cover (including helicopter) is mandatory. Cancellation insurance is strongly recommended.
  • Documents: The traveller is responsible for a valid passport, visa and vaccinations and must carry the passport with the number given at booking on the trek and at Machu Picchu.

8. Liability, complaints and applicable law

  • Liability: Incatrekkers is liable for its own services with the diligence of a responsible tour operator. It is not liable for third-party services booked by the traveller (for example flights) or for delays or cancellations by airlines and trains.
  • Luggage and valuables: In the event of loss of or damage to luggage during the trip, Incatrekkers' liability is limited to USD 100 per traveller, except in cases of intent or gross negligence. Due to the nature of the activities, we recommend not bringing valuables (cash, jewellery, high-end electronic devices, etc.). Incatrekkers accepts no liability and makes no refunds for the loss of or damage to such items.
  • Complaints: The traveller reports any problem immediately to the guide or the office in Cusco so that it can be solved on site. Written complaints must be sent within 7 days after the trip to info@incatrekkers.com.
  • Libro de Reclamaciones: Under the Peruvian Consumer Protection Code (Ley N.º 29571), Incatrekkers keeps a complaints book (Libro de Reclamaciones) at its office and as a virtual complaints book on its website. Incatrekkers responds to every complaint within the legal deadline. The traveller may also contact INDECOPI, the Peruvian consumer protection authority.
  • Photos: Incatrekkers may use group photos taken on tours for its own purposes unless the traveller objects.
  • Data protection: Incatrekkers processes personal data in accordance with Law No. 29733. More information in the privacy policy.
  • Applicable law and jurisdiction: Peruvian law applies; the place of jurisdiction is Cusco. Mandatory consumer protection rights in the traveller's country of residence remain unaffected.

The Spanish version of these terms is legally binding.
